Privacy Policy of Globetek Ltd.
§1 Glossary:
- Privacy Policy – means this document entitled Privacy Policy of Globetek Ltd,
- Globetek – this is Globetek Ltd. based in Chorzow, address: 83 Leśna Street, 41-506 Chorzów, KRS No. 0000392171, NIP: 6342792088, www.globetek.pl, e-mail: dpa@globetek.pl,
- RODO – Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, OJ. EU. L. of 2016. No. 119, p. 1 as amended);
- Administrator – The controller of the personal data is Globetek, pursuant to Article 4 point. 7 RODO;
- Candidate – any natural person participating in the recruitment process conducted or coordinated by Globetek, or using other services provided by Globetek,
- Client – means the entity for which Globetek provides personnel search services, based on a separate contract. The Client is also the recipient of the data pursuant to Article 13 (1) (e) of the RODO;
- Recruitment Process – it is understood as all activities of Globetek, consisting of acquiring information about the Candidate, conducting contacts with the Candidate and the Client and presenting the Candidate to the Client for a specific position, with the aim of hiring the Candidate, preparing to conclude a contract of employment, surveying satisfaction with the Recruitment process , these activities are described in detail here: https://globetek.pl/dla-kandydatow/proces-rekrutacyjny/,
- Employment – it is understood as any form of establishment of cooperation between the Candidate and the Client, including: employment contract, civil law contract, internship, business activity conducted by the Candidate for the Client, as well as the actual undertaking of activities or any cooperation, in any form, by the Candidate for the Client.
§2 General Provisions.
- In this document, we set out the principles for the processing and handling of Candidate’s personal data in accordance with relevant laws.
- The protection of Candidates’ personal data is very important to us, and we do our due diligence to ensure that our activities in this area comply with relevant laws, in particular the RODO.
- Our goal is to give you control over our processing of your personal data and to provide you with tools to exercise your rights.
- Globetek conducts activities including everything related to employment, and in order to perform activities for the benefit of the Candidate and the Client, it is necessary for Globetek to process the Candidate’s personal data (Article 6(1)(b) of the RODO).
- The Candidate’s personal data is processed on the basis of Article 6 (1) (b) of the RODO; the Candidate knowingly and voluntarily provides his/her personal data by sending his/her resume to the address indicated by Globetek with the following statement: “I hereby declare that I have read Globetek’s Privacy Policy, which I have obtained by e-mail, and which I fully understand and accept.”.
- Globetek, pursuant to Article 13 (1) (a) of the RODO, informs that it is the Controller (in terms of Article 4 (7) of the RODO), of the Candidate’s personal data (in terms of Article 4 (1) of the RODO). The contact details of the Administrator are shown in § 1 para. 2.
- Globetek informs that it has not appointed a Personal Data Supervisor in its company, as there are no circumstances that would require it, in accordance with the provisions of the RODO (Article 4.1.b).
- Globetek informs that potential recipients of the data are only Customers, entities handling Globetek’s accounting and legal affairs, entities maintaining the database, and entities acting on Globetek’s behalf. Personal data will not be transferred to a third country or international organization.
§3 Processing of personal data.
- Globetek processes and stores Candidates’ personal data on the basis described below.
- Due to our business and the clients we work with, from the very beginning our priority has been to protect the privacy of both parties, which is why we store all personal data collected by us, in a secured electronic database. Only persons authorized in writing by the Administrator have access to the database and may process it only for the purposes described below.
- Out of concern for the security of the data entrusted to us, we have developed internal procedures and recommendations to prevent data from being made available to unauthorized persons. We control their execution and constantly check their compliance with relevant legal acts, in particular the RODO, the Law of May 10, 2018 on the Protection of Personal Data, and other applicable legal acts.
- Purpose of processing – We process personal data lawfully on the basis of the consent given in the form of a written clause in the resume, or given in our system. The main purpose of processing personal data is to find the Candidate a job and the Client an employee. For this purpose, we may share the Candidate’s resume with the Client in accordance with the Recruitment Process. Before sharing any data or information with the Client, we always contact the Candidate first (by phone or email) with a presentation of the job offer and in order to obtain the Candidate’s consent or refusal to participate in the recruitment in question.
- In other cases, we may employ the Candidate directly with us, so the personal data will be processed for the purpose of entering into a contract of employment, commission or otherwise. Before signing a contract, the Candidate must go through medical examinations, often height tests, and this involves a number of visits to specialists, who also need to have access to personal data. Personal data may also be transferred to a fourth party, in the event that a Candidate employed by Globetek, performing work directly for our Client at an industrial site (e.g. power plant, refinery, shipyard, paper mills, etc.) must go through internal health and safety training at the site and obtain an entry pass.
- Personal data will not be processed for any purpose other than those described above.
§4 Period of storage of personal data.
1.Your personal data will not be kept longer than required by law. For example, we keep tax data as required by Polish law for 5 years, employment data for 10 years, and electronic data such as resume, contact history, contact data such as phone number, email address, etc. for a period of 36 months from the date of last contact from our side. 2.At any time, the Candidate has: 1) the right to obtain any information as to the personal data used, as well as the rights related to the transfer of 2) personal data, the right to access personal data, 3) the right to request the rectification of personal data that is incorrect, 4) the right to request the completion of personal data that is incomplete, 5) the right to request the deletion of personal data, with the right to request in strictly defined situations as specified in Article 17 of RODO, 6) the right to request restriction of processing of personal data, with the right to request in strictly defined situations as specified in Article 18 of RODO, 7) the right to receive personal data in a commonly used machine-readable format such as a copy of such data, 8) the right to send the received personal data to another controller without any hindrance from the controller, 9)the right to object to the processing at any time, with this entitlement being granted in strictly defined cases specified in Article 21 of RODO, 10)the right to lodge a complaint to the supervisory authority in charge of personal data protection, which in Poland is the President of the Office for Personal Data Protection, 11)the right to withdraw consent to the processing of personal data at any time, with this entitlement being granted only with regard to such processing which was performed under a separately expressed consent. (3)In order to exercise the above-mentioned rights, please send an email to the Personal Data Administrator at: dpa@globetek.pl providing your name, surname, date of birth and mailing address. We treat each such request in a special way, so as soon as possible we will contact the applicant by phone to verify identity. (4) We warn you that we will not send any personal information – we can only confirm the fact of its existence in our database, its source and removal from the database. (5) If for any reason you feel that our service has been unsatisfactory, you may file a complaint with the President of the Office for Personal Data Protection.
§5 Cookies and profiling
1.Our website at www.globetek.pl uses “cookies” for statistical purposes and to adapt the content of the website to you and your device. You can change the settings in your web browser so that your device does not save cookies. 2.The statistics that are collected are: 1) the number of visits and page views of our site,
2)information about your browser and operating system,
3)referral sites and services,
4) IP address and geographic location. 3You have control over your web browser and its settings. Recipients of personal data may be Google, Facebook, LinkedIN. 4. profiling is used in Google Analytics, Google Ads, Facebook Pixel. If you object to profiling, please optimize your browser accordingly. 5. the Site uses a Facebook and LinkedIN content sharing plugin to allow you to share content from our Site using your Facebook and LinkedIN account. This plug-in may collect data such as your IP address, your browser, store and retrieve cookies in your browser, embed additional tracking, and monitor your interaction with the commenting interface, including correlating your Facebook / LinkedIN account with any actions you take in the interface (e.g., as “liking” someone’s comment, responding to other comments), if you are logged into Facebook. §6 Amendment of Privacy Policy.
We reserve the right to change the above Privacy Policy by publishing a new Privacy Policy on the website or by publishing the current Privacy Policy with the changes on our website. Changes may be dictated, in particular, by the development of Internet technology, possible changes in applicable data protection laws and the development of the website itself.
